We offer the Services only for personal, noncommercial use, and not for the use or benefit of any third party (unless you are a parent or legal guardian using the Services for your minor child).

You may be able to navigate some of the Services without creating a user account (”Sign on or Account”); but certain Services (like making shopping our selection online ) to make a purchase we will require you to create an Account.   2. Selecting Your Frames.

Eyes On Brickell PA sells eyeglasses and sunglasses with either prescription or non-prescription lenses. To learn more about the lenses we offer, you can visit the Lenses section on our website. If you wish to purchase multiple frames using different prescriptions (for example, your distance prescription and your reading prescription), you will have to place those orders separately. To order frames, select your desired frame and click the “Add to Cart” button to add it to your order. When you check out, you will have the option of choosing between prescription and non-prescription lenses.

  1. Your Prescription.

If you are purchasing prescription eyewear, please input the corresponding prescription information before you check out or upload a picture of your prescription as indicated by the camera icon. If your prescription information is incomplete, we may need to take additional measures to track down current information, which could mean you have to wait longer for your glasses.

We keep your prescription on file for some time after you order your glasses, and we make that information available to you upon request. We will respond to your request as quickly as possible, but be aware that it could take us a day or two to retrieve older prescriptions. Please keep that in mind if you need your information by a certain day or time. By requesting a copy of your prescription, you consent to Eyes On Brickell PA or an affiliated eye doctor sending your prescription over unencrypted email. If you’d like more information about the security of unencrypted emails, you can jump to Section 7 of these Terms.

  • Delivery Information.

We’ll need your name, address, and telephone number to complete your order and send you your eyewear purchase. All prescriptions purchases will be send via tracking information and will be available upon your request.

  • Payment Information.

After you have made your eyewear selections and provided your prescription and shipping information, you will see a prompt for your payment details, such as your credit card information and any promotional codes or gift cards you may have. By entering your payment information and submitting your order, you authorize us and our third party payment processors to charge the amount of the order to your selected payment method.

  • Checking Order Status.

  • Changing or Cancelling an Order.

Our team works hard to process orders quickly so that you don’t have to wait. However, this means that although we will try our best to accommodate order modifications, we cannot guarantee them

  • Risk of Loss.

The risk of loss and title for all products you order passes to you upon our delivery to the carrier (such as FedEx, UPS, or USPS).

  • Returns, Exchanges, and Lens Replacements

your eyewear comes with a 1 year, 1 time replacement guarantee for scratches or breakages. You are required to send your damaged glasses back and inform us in writing of your request before we can process your replacement. We can be reached at eyesonbrickell@gmail.com

  • Insurance.

Purchased made online will require you to submit a claim directly with your insurance company. We will provide you with a detailed receipt so you many submit your claim accordingly.

  • Purchase Limits.

We want to give all of our customers an opportunity to buy our glasses. And have options for commercial purchase please email us at eyesonbrickell@gmail.com should you require this service. We reserve the right to limit, cancel or prohibit orders that, in our judgment, appear to be placed with an intent to resell or distribute our products. We further reserve the right to stop doing business with customers who violate this policy or any other part of our Terms..

  • Language.

Presently, our order process only supports the English language.

Eyes On Brickell PA operates Bookly, which allows users to search for and book an eye exam. When using Bookly appointment scheduling system, you may be asked to submit personal information including your name, email address, telephone number, insurance information and credit card information to reserve your appointment. .

  1. Dispute Resolution and Arbitration

In the interest of resolving disputes between you and Eyes On Brickell PA in the most expedient and cost effective manner, you and Eyes On Brickell PA agree that every dispute arising out of or in connection with these Terms or your use of the Services will be resolved by binding arbitration. Arbitration is less formal than a lawsuit in court. Arbitration uses a neutral arbitrator instead of a judge or jury, may allow for more limited discovery than in court, and may be subject to very limited review by courts. Arbitrators can award the same damages and relief that a court can award. This agreement to arbitrate disputes includes all claims arising out of or relating to any aspect of these Terms or your use of the Services, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and regardless of whether a claim arises during or after the termination of these Terms. YOU UNDERSTAND AND AGREE THAT, BY ENTERING INTO THESE TERMS, YOU AND Eyes On Brickell PA ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION.

  1. Exceptions.

Despite the provisions of Section 18(a) nothing in these Terms will be deemed to waive, preclude, or otherwise limit the right of either party to: (i) bring an individual action in small claims court; (ii) pursue an enforcement action through the applicable federal, state, or local agency if that action is available; (iii) seek injunctive relief in a court of law; or (iv) to file suit in a court of law to address an intellectual property infringement claim.

  1. Arbitrator.

Any arbitration between you and Eyes On Brickell PA will be settled under the Federal Arbitration Act, and governed by the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by these Terms, and will be administered by the AAA. The AAA Rules and filing forms are available online at www.adr.org, by calling the AAA at 1-800-778-7879, or by contacting Eyes On Brickell PA . The arbitrator has exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this binding arbitration agreement.

  1. Notice; Process.

A party who intends to seek arbitration must first send a written notice of the dispute to the other party by certified U.S. Mail or by Federal Express (signature required) or, only if such other party has not provided a current physical address, then by electronic mail (“Notice”). Eyes On Brickell PA ‘s address for Notice is: 1925 Brickell Ave. D301 Miami FL 33129, Attn: Legal Department. The Notice must: (i) describe the nature and basis of the claim or dispute; and (ii) set forth the specific relief sought (“Demand”). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within 30 days after the Notice is received, you or Eyes On Brickell PA may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or Eyes On Brickell PA must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any. If the dispute is finally resolved through arbitration in your favor, we will pay you the highest of the following: (i) the amount awarded by the arbitrator, if any; (ii) the last written settlement amount offered by Eyes On Brickell PA in settlement of the dispute prior to the arbitrator’s award; or (iii) $1,000.

  1. Fees.

If you commence arbitration in accordance with these Terms, we will reimburse you for your payment of the filing fee, unless your claim is for more than $10,000, in which case the payment of any fees will be decided by the AAA Rules. Any arbitration hearing will take place at a location to be agreed upon in Miami –Dade, Florida, but if the claim is for $10,000 or less, you may choose whether the arbitration will be conducted: (i) solely on the basis of documents submitted to the arbitrator; (ii) through a non-appearance based telephone hearing; or (iii) by an in-person hearing as established by the AAA Rules in the county (or parish) of your billing address. If the arbitrator finds that either the substance of your claim or the relief sought in the Demand is frivolous or brought for an improper purpose (as measured by the standards set forth in Federal Rule of Civil Procedure 11(b)), then the payment of all fees will be governed by the AAA Rules. In that case, you agree to reimburse Eyes On Brickell PA for all monies previously disbursed by it that are otherwise your obligation to pay under the AAA Rules. Regardless of the manner in which the arbitration is conducted, the arbitrator must issue a reasoned written decision sufficient to explain the essential findings and conclusions on which the decision and award, if any, are based. The arbitrator may make rulings and resolve disputes as to the payment and reimbursement of fees or expenses at any time during the proceeding and upon request from either party made within 14 days of the arbitrator’s ruling on the merits.

  1. No Class Actions.

YOU AND Eyes On Brickell PA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and Eyes On Brickell PA agree otherwise, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

  1. Modifications to this Arbitration Provision.

If we make any future change to this arbitration provision, other than a change to our address for Notice, you may reject the change by sending us written notice to our address for Notice within 30 days of the change, in which case your account with Eyes On Brickell PA will be immediately terminated and this arbitration provision, as in effect immediately prior to the changes you rejected, will survive.

  1. Enforceability.

If Section 18(f) is found to be unenforceable or if the entirety of this Section 18(f) is found to be unenforceable, then the entirety of this Section 18 will be null and void and, in that case, the parties agree that the exclusive jurisdiction and venue described in Section 18 will govern any action arising out of or related to these Terms.

  1. Severability

If it turns out that any part of these Terms are invalid, void, or for any reason unenforceable, that term will be deemed severable and limited or eliminated to the minimum extent necessary. The limitation or elimination of the term will not affect any other terms. NOTHING IN THESE TERMS WILL AFFECT ANY NON-WAIVABLE STATUTORY RIGHTS THAT APPLY TO YOU.

  1. Consent to Electronic Communications

By using the Services, you consent to receiving certain electronic communications from us as further described in our Privacy Policy. Please read our Privacy policy to learn more about our electronic communications practices. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements, including that those communications be in writing.

  1. Entire Agreement

These Terms constitute the entire agreement between you and Eyes On Brickell PA and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to these Services. Any rights not expressly granted herein are reserved.

  1. Miscellaneous

We take our commitment to customers seriously, and we’ll do what we can for you. However, sometimes things may come up that are outside of our control. We will not be liable for any failure to perform any of our obligations stated in these Terms if the failure results from a cause beyond our reasonable control, including mechanical, electronic or communications failure or degradation.

You cannot assign, transfer or sublicense these Terms without first obtaining our consent. We may assign, transfer, or delegate any of our rights and obligations without your consent. These Terms do not create any agency, partnership, joint venture, or employment relationship, and neither party has any authority to bind the other in any respect.

If we do not enforce any part of these Terms, it does not mean we give up the right to later enforce that or any other part of these Terms. In order for any waiver of compliance with these Terms to be binding, we must provide you with written notice of such waiver through one of our authorized representatives.

The section and paragraph headings in these Terms are for convenience only and do not affect their interpretation.
